Terms of Service — Affirmation Counter

Effective date: October 3, 2026

Company: Daybreak Labs

App: Affirmation Counter (Android)

Contact: [email protected]

These Terms of Service (“Terms”) govern your use of Affirmation Counter (the “App”) provided by Daybreak Labs (“we,” “us”). By downloading or using the App, you agree to these Terms.

The App

Affirmation Counter helps you practice spoken affirmations and track practice activity (counts, sessions, history, and related progress features). An optional Premium subscription adds the features listed under “Free and Premium” below.

The App is wellness / self-improvement software. It is not medical, mental-health, or therapeutic advice and is not a substitute for professional care.

Eligibility

You must be able to form a binding contract under applicable law and meet Google Play’s age requirements. If you are under the age of majority where you live, you may use the App only with a parent/guardian’s permission.

Accounts

• You can use the App without creating an account. The only way to sign in is Google Sign-In; the App has no email-and-password sign-in.
• Optional Google Sign-In turns on Cloud backup with Google (included with Premium), which links your backed-up sessions and history to your Google account.
• You are responsible for activity under your signed-in account and for keeping your Google account secure.

Free and Premium

• Free: Speak and count your affirmations, practice history, streaks, reminders, home-screen widgets, and the Morning Energy journey, with up to 3 saved sessions. Your data stays on your device.
• Premium includes:
  • Belief Meter: see how strongly you believe your affirmation, rep by rep, and your belief trend over time
  • Unlimited sessions (the free plan includes 3)
  • All 6 journeys (the free plan includes Morning Energy): Morning Energy, Self-Love, Gratitude, Stress Relief, Afternoon Focus and Evening Wind-Down
  • Cloud backup with Google: when you sign in with Google, your sessions and history are backed up to your Google account and can be restored on a new phone

Subscriptions, free trial and cancellation

• Premium is an auto-renewing subscription, billed monthly or yearly through Google Play Billing. The price and billing period are shown in the App before you subscribe.
• Free trial: new subscribers may get a 7-day free trial. If you don’t cancel before the trial ends, your subscription starts and you are charged the price shown for your plan. Cancel before the trial ends and you won’t be charged.
• Your subscription renews automatically at the end of each billing period until you cancel.
• Cancel anytime in Google Play: Play Store > Profile > Payments & subscriptions > Subscriptions, or play.google.com/store/account/subscriptions. Cancelling stops future renewals; Premium stays active until the end of the current period. Uninstalling the App or deleting your account does not cancel a subscription.
• Refunds are handled by Google under Google Play policies.

Acceptable use

You agree not to:

• Misuse the App or attempt to disrupt our services or other users
• Reverse engineer the App except where allowed by law
• Use the App for unlawful purposes
• Attempt unauthorized access to accounts or cloud data

Intellectual property

The App, branding, and content we provide are owned by Daybreak Labs or our licensors. Affirmation text you practice remains yours; you grant us a limited license to process technical data needed to operate the App (for example backing up your data with Cloud backup with Google).

Third-party services

The App depends on Google Sign-In, Google Play, Play Billing, and Firebase. Your use of those services is also subject to Google’s terms and policies.

Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or any particular wellness outcome.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYBREAK LABS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.

Termination

You may stop using the App at any time (uninstall / sign out). We may suspend or terminate access if you violate these Terms or if we discontinue the App. Provisions that should survive (including ownership, disclaimers, and liability limits) will survive termination.

Changes

We may update these Terms. Continued use after changes become effective means you accept the updated Terms. Material changes may be highlighted in the App or on our website.

Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
