These Terms of Service (“Terms”) govern your use of Affirmation Counter (the “App”) provided by Daybreak Labs (“we,” “us”). By downloading or using the App, you agree to these Terms.
Affirmation Counter helps you practice spoken affirmations and track practice activity (counts, sessions, history, and related progress features). Optional Premium features may include cloud sync of history/streaks/progress when you sign in with Google.
The App is wellness / self-improvement software. It is not medical, mental-health, or therapeutic advice and is not a substitute for professional care.
You must be able to form a binding contract under applicable law and meet Google Play’s age requirements. If you are under the age of majority where you live, you may use the App only with a parent/guardian’s permission.
Subscriptions renew according to Google Play’s terms unless canceled in your Google Play account settings. Refunds are handled by Google under Google Play policies.

The App, branding, and content we provide are owned by Daybreak Labs or our licensors. Affirmation text you practice remains yours; you grant us a limited license to process technical data needed to operate the App (for example syncing Premium cloud data).
The App depends on Google Sign-In, Google Play, Play Billing, and Firebase. Your use of those services is also subject to Google’s terms and policies.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or any particular wellness outcome.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYBREAK LABS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.
You may stop using the App at any time (uninstall / sign out). We may suspend or terminate access if you violate these Terms or if we discontinue the App. Provisions that should survive (including ownership, disclaimers, and liability limits) will survive termination.
We may update these Terms. Continued use after changes become effective means you accept the updated Terms. Material changes may be highlighted in the App or on our website.
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
